End User License Agreement (EULA)

Parties Involved:

Yumgo Srl, with its registered office at Piazza Gae Aulenti 1 - Torre B, VAT number 13183170961, hereinafter referred to as 'Yumgo'.

The owner of the business using the Yumgo app, hereinafter referred to as 'User'.

1. Purpose

This agreement governs the use of the Yumgo application by the User, allowing the creation of a digital menu and the management of orders and payments within their establishment.

2. Use of the Yumgo App

The User agrees to use the Yumgo application exclusively for commercial purposes related to the management of a restaurant business or the sale of food and beverage products. The User is responsible for the accuracy and completeness of the information entered into the application.

3. Third-Party Services

Yumgo uses the following third-party services:

• Stripe: for payment processing. The User acknowledges and agrees that Stripe is an independent service and accepts Stripe's terms and conditions for payment processing.
• Mailjet: for sending transactional emails. The User understands that Mailjet is an external service and agrees to Mailjet's terms of use for sending communications.
• Google Analytics: for analyzing application usage. The User understands and agrees that Google Analytics is an external service that collects data on application usage.

4. User Responsibilities

The User is responsible for the accuracy of the data provided through the Yumgo application. Yumgo is not responsible for any losses, damages, or claims arising from inaccurate or incorrect information provided by the User.

5. Limitation of Liability

Yumgo shall not be liable for direct, indirect, incidental, special damages arising from the use or inability to use the application, including damages for loss of profits, data, or any other financial loss.

6. Confidentiality and Data Protection

Yumgo implements security measures to protect User data. The User understands that Yumgo may collect and process data in accordance with applicable privacy regulations.

7. Amendments to the Agreement

Yumgo reserves the right to make changes to this agreement, notifying the User of any modifications. Continued use of the application constitutes acceptance of the new terms.

8. Applicable Law and Jurisdiction

This agreement is governed by Italian law. Any dispute arising from this agreement shall be subject to the exclusive jurisdiction of the competent courts in Milan.

By accepting the terms of this agreement, the User confirms that they have read, understood, and accepted all the terms and conditions set forth herein.
